Terms of SERVICE
By continuing to book with Shoreline Media Co., you are agreeing to the following terms & conditions.
OWNERSHIP OF DELIVERABLE MATERIALS
- All photographs, videos, and other deliverable materials (collectively referred to as "content") created by Shoreline Media Co during the provision of service is the exclusive property of Shoreline Media Co unless otherwise specified in writing.
- Upon full payment of the agreed-upon amount, Shoreline Media Co grants the clients a non-exclusive, non-transferable license to use the Content for the sole purposes of marketing and promoting the subject property & the Realtor's business.
- The client may not sublicense, sell, modify, or otherwise distribute the Content without the express written consent of Shoreline Media Co.
- The client may not interfere in any capacity with Shoreline Media Co sublicensing the Content.
- Shoreline Media Co retains the right to use the Content for promotional and marketing purposes, including but not limited to, showcasing in portfolios, websites, and in marketing materials, unless otherwise agreed upon in writing with the client
- Shoreline Media Co retains the right to sublicense, sell, modify, or otherwise distribute the Content without express written consent from the client.
- Any unauthorized use or reproduction of the Content is strictly prohibited and may result in legal action by Shoreline Media Co to enforce its intellectual property rights.
MATERIAL STORAGE
- Edited Content will remain stored on Aryeo, Google Drive, or HD Photo Hub for at least 30 days. After which, Shoreline Media Co reserves the right to take it down at any point.
- Shoreline Media Co will make every effort to maintain storage of the raw files indefinitely. However, we can only guarantee the storage of raw files for a duration of 1 year from the date of the appointment.
- Clients are responsible for backing up and preserving their material as Shoreline Media Co cannot be held accountable for the loss of material after the specified storage periods have elapsed.
- Raw files will not be given to the client
- Raw files are available for purchase by the client at a price of $1000.
AVAILABILITY & SCHEDULING
- Shoreline Media Co shall make reasonable effort to accommodate your preferred booking times and dates as specified on the Online Booking System or through email or call. However, we cannot guarantee the availability of specific time slows due to factors such as prior bookings, weather conditions, and other scheduling constraints.
- In cases where we are unable to accommodate your preferred time or date, we will work with you to find an appropriate alternative arrangement.
- We kindly request a 15-minute grace period in arrival to account for any unexpected delays. This grace period allows us to ensure that we can provide a quality service without rushing.
- If we anticipate a delay beyond 15 minutes, we will make our best efforts to notify you as soon as possible.
COMMUNICATION
- Clients are required to communicate with Shoreline Media Co through official channels only - this includes email, our office phone number, and Instagram messaging. These contact methods ensure efficient and professional communication between clients and the company
- Clients are strictly prohibited from directly contacting individual photographers or team members working under Shoreline Media Co. This includes the use of their personal phone numbers or social media accounts.
- Abusive language will not be tolerated on any level. Shoreline Media Co reserves the right to pull our photographers or team members out of any scenario we deem abusive or unsafe.
DELIVERY TIMES
- Shoreline Media Co strives to deliver the Content as quickly as possible while maintaining the highest quality standards.
- Clients can expect their photographs delivered by 9:00pm next business day. Video delivery can take up to 2 business days. Special projects, twilights, Prestige Packages, or similar may expect their material longer.
- Shoreline Media Co will communicate any expected delays in advance.
- Rush Fees are subject to availability but guarantee material be delivered in the agreed upon time.
- iGuides, Virtual Staging, and Floor Plans cannot be expedited or guaranteed due to their unique requirements.
PAYMENTS & INVOICES
- Under most circumstances, all payments must be received before downloads are authorized.
- The client may opt for an invoice payment option instead under certain cases.
- Invoices are sent every 2 weeks through Square.
- Invoices not paid within 14 days are subject to late fees
- All overdue invoices will be subject to an immediate $20 admin fee on the 15th overdue day. The late fee is then calculated as 25% of the total invoice amount before tax, divided by 12 months, and assessed every 30 days until the outstanding balance is paid.
CANCELATIONS & UNPREPARED PROPERTIES
- Clients may cancel their real estate photography appointment without incurring a cancelation fee if cancelled 24 hours before the scheduled appointment.
- Cancellations received after 9:00PM local time on the day before the scheduled appointment but more than 1 hour before the appointment time will be subject to a cancellation fee equal to 50% of the appointment value.
- Cancellations received 1 hour to sooner to the appointment will be subject to a cancellation fee equal to 100% of the appointment value.
- Any additional expenses (venue rental, model/actor fees) are the Clients responsibility whether the appointment is cancelled or not.
- Cancellations due to inclement weather (heavy rain/snow, natural disasters, or any condition that poses a significant risk to the safety of our team or the quality of the photography, are not subject to a cancellation fee. However, light rain/snow, or cloudy days are not considered viable reasons for cancellations.
- Travel fees may apply in the event of a partial cancellation.
- It is the clients responsibility to ensure the property is in a photographable state. Our team can assist in staging suggestions, but we take no responsibility for cleaning or moving items.
- If the property is not ready at the scheduled appointment time, the client will be billed at a rate of $25 per 15-minute increment, with the first 15 minutes exempt from billing.
- The photographer reserves the right to cancel or reschedule the appointment at their discretion if the client has not adequately prepared the property. The client may receive a cancelation fee as outlined in the Terms of Service.
SQUARE FOOTAGE POLICY
- It is the responsibility of the client to provide accurate square footage information when booking services to ensure proper pricing. If the property size exceeds the quoted square footage at the time of booking, we reserve the right to adjust the pricing based on the actual square footage measured on-site.
- In the even of a discrepancy, additional charges will be automatically applied without prior notice. By scheduling services, the client agrees to this policy and accepts responsibility for any adjustments required due to inaccurate square footage estimates provided at time of the booking.
Shoreline Media Co reserves the right to add to or change the terms of service at any point. Notification of any changes will be made aware to the client as soon as possible.
